Agent commissions

There are several very important legal requirements concerning commissions that you should be aware of:-

* agents must tell you that their commission and marketing expenses are negotiable before you sign a sales authority.
* an agent cannot seek payment of a commission unless he holds a written authority.
* you must be given a copy of the written authority.

There is a penalty of 100 penalty units for non-compliance of the above ($122.14 X 100 = $12,214 in the financial year to June 2012). Full details concerning the above can be found in the Estate Agents Act 1980 Section 49A. See Victorian Legislation

Agents in the local area generally charge around 3.0 % plus GST.

Some also have a marketing fee of $2,000 which includes two small advertisements in the local paper which cost a total of around $200 and then say the remaining $1,800 goes towards printing and internet costs which are provided for free by nearly all the other local agents.
